Expert Legal Support for

Care Proceedings Involving Child Sexual Abuse and Exploitation

At Ridley & Hall, we specialise in representing parents and families in complex care proceedings where children are at risk of child sexual abuse (CSA), child sexual exploitation (CSE), or child criminal exploitation (CCE). These cases require not only legal expertise but also a deep understanding of trauma, safeguarding, and multi-agency working.

Child Sexual Abuse (CSA)

Our team has extensive experience in supporting families where children have been harmed or are at risk of sexual abuse. These are incredibly sensitive cases that require legal knowledge, empathy, and clear communication.

We regularly advise on:

• Achieving Best Evidence (ABE) interviews
• Re W applications (where a child may be asked to give evidence)
• Specialist risk assessments
• Finding of Fact hearings

We guide clients through every stage of the process, ensuring they are fully informed and supported throughout.

Child Sexual and Criminal Exploitation (CSE & CCE)

Exploitation cases can be especially complex, as risks often come from outside the family home. Unfortunately, parents are sometimes wrongly blamed when their child is being exploited.

Common legal routes in these cases may include:

  • Public Law Outline (PLO) process
  • Section 20 accommodation
  • Care proceedings for children ‘beyond parental control’

Our team recognise that any child can be exploited and that the fault lies firmly with the perpetrators of the abuse and is never the fault of the child. We understand the pain and trauma for parents and families of children who are being exploited, and the desperate wish to keep them safe.  We advocate for a contextual safeguarding approach, ensuring that all services focus on the root causes of exploitation, not blame the child or their family.

Challenging Victim-Blaming Language

We are highly skilled in identifying and challenging victim-blaming language in reports and court documents. This is crucial in ensuring children are properly safeguarded and treated with respect.

Some phrases to avoid include:

  • “Putting themselves at risk”
  • “Glamorising gang lifestyles”
  • “Making poor choices”
  • “Persistently absconding”
  • “In a relationship with” / “boyfriend/girlfriend”
  • “Sexually active”
  • “Chaotic lifestyle”
  • “Drug runner” / “money mule” / “cuckooing” / “trapping”

These terms shift blame onto children and fail to recognise that they are victims of abuse and trafficking.

Specialist Expertise

All of our solicitors are Children Panel Accredited, meaning they have demonstrated significant expertise in representing parents and children in public law cases.

Zoe Butt, a specialist solicitor at Ridley & Hall, has particular expertise in child exploitation. She is a Trustee of Ivison Trust, a leading charity supporting families affected by exploitation. Zoe has completed advanced training in contextual safeguarding and delivers clear, practical advice to families facing these traumatic situations.

Case Spotlight

We represented a parent within care proceedings whose child was being both sexually and criminally exploited. We challenged victim blaming language within social work documentation, ensuring that this was corrected. We advocated for and obtained expert reports to secure recommendations as to how the child could be safeguarded and supported. We ensured appropriate support services and work was implemented for both the child and the parent. A positive outcome was secured for the family with the right support in place to move forward.

Frequently Asked Questions

What are care proceedings involving child sexual abuse or exploitation?

Care proceedings are legal processes started by the local authority when there are serious concerns about a child’s safety. In cases involving child sexual abuse (CSA) or exploitation (CSE/CCE), the court will consider whether the child needs protection and what support or orders are needed.

Can I lose my child if they are being exploited outside the home?

Sometimes the Local Authority may commence care proceedings and seek removal of a child into care as a means of removing them from the risk of harm. Given that in exploitation cases the risk is external (i.e. outside the family home) this is often not the answer. We will work with you to find out your views and what you want to happen, support you to put your case to the court and focus on ensuring that the right support is in place for your family.

What is contextual safeguarding?

Contextual safeguarding recognises that risks to children often come from outside the home. The current approach to child protection struggles to work with families when the risk comes from outside the home, and contextual safeguarding encourages a multi-agency approach to improve safety planning. We ensure that professionals consider this wider context when making decisions.

What happens if my child is “beyond parental control”?

The Local Authority may seek to commence the PLO process, care proceedings or ask you for Section 20 consent. The consequences of child exploitation can often mean that it is not possible for parents to keep the child safe at home. Some parents in this situation agree that it is the right thing for the child to be removed from their care in the hope that they can be placed away from the locations where they are being exploited. Every case is different and we will work with you to fight for the right outcome in your case.  We will help you explain the exploitation behind your child’s behaviour and advocate for appropriate support rather than blame.

What is victim-blaming language in care proceedings?

Victim-blaming language wrongly suggests a child is responsible for their own exploitation or abuse. We actively challenge these harmful terms in official documents and work to ensure that professionals understand the exploitation that has taken place.

Can my child give evidence in a care case involving sexual abuse?

Possibly. In rare cases, courts may consider a Re W application, allowing a child to give evidence. We will advise you on whether this applies and what protections are available for your child.

What support can I get as a parent during care proceedings?

You are entitled to free legal advice if you are a parent involved in care proceedings. Our team will explain the process, represent you in court, and ensure your voice is heard throughout.

What if I disagree with the social worker’s assessment?

You have the right to challenge assessments and reports. We regularly review and question flawed or biased assessments — especially those that include inappropriate language or assumptions.

Can my child be removed under Section 20 without a court order?

Yes, but only with your consent. Section 20 allows a child to be accommodated by the local authority voluntarily. You can revoke your consent at any time. If you’re under pressure to agree, contact us immediately for legal advice.

Why choose Ridley & Hall for cases involving exploitation or abuse?

We have a specialist care team with deep expertise in CSA, CSE, and CCE cases. All our solicitors are Children Panel Accredited, and solicitor Zoe Butt has particular expertise in child exploitation and contextual safeguarding.
