Who can apply for a spouse visa?

Who can apply for a spouse visa?

You may be eligible to apply for a spouse visa if your partner is living in the UK and holds one of the following statuses:

  • British citizenship
  • Irish citizenship
  • Indefinite Leave to Remain (ILR)
  • EU Settled Status

Both partners must be aged 18 or over and intend to live together permanently in the UK.

Applications can be made either:

  • From outside the UK to join your partner, or
  • From inside the UK if you are switching from an eligible visa.

English language requirement

Most applicants must prove a basic knowledge of English when applying for their first spouse visa.

This can usually be shown by:

  • Passing an approved English language test at A1 level or higher, or
  • Holding a degree taught in English that is recognised as equivalent to a UK degree.

Some applicants are exempt, such as those over 65 or with certain medical conditions.

How long does a Spouse Visa last?

How long does a Spouse Visa last?

A spouse visa is usually granted for 30 months (2.5 years).

Before it expires, you can apply to extend it for a further 30 months. After five years in the UK on the partner route, you may be eligible to apply for Indefinite Leave to Remain (ILR).
