The Problem Isn’t the Divorce – It’s the Lack of Understanding

Reading headlines about celebrity couples securing a “quick online divorce” is frustrating, not because of the divorce itself, but because of the misunderstanding these stories can create.

Recently, reports about Tess Daly and Vernon Kay obtaining a faster divorce online highlighted what is becoming a common narrative: that divorce is something that should be quick, simple and handled digitally with minimal professional involvement. While that may make for an appealing headline, it risks missing a crucial point.

The divorce process itself is rarely the part that causes delay.

In England and Wales, the legal process of obtaining a divorce has become more streamlined, particularly since the introduction of no-fault divorce. In many cases, the paperwork can be completed relatively efficiently. The real challenge is not ending the marriage; it is resolving the financial arrangements that follow.

This is where obtaining tailored legal advice matters.

Too often, people are encouraged to focus on obtaining the divorce as quickly and cheaply as possible. They may be attracted by online services promising a straightforward solution at a fraction of the cost of traditional legal advice. However, what many do not realise is that a divorce order alone does not necessarily resolve financial claims between couples.

Without appropriate legal advice and a properly drafted financial settlement, individuals can leave themselves exposed to future claims long after they believe everything has been concluded.

The irony is that obtaining good legal advice early on does not have to be expensive, confrontational or drawn out. In fact, the opposite is often true.

When separating couples receive clear advice at the outset, they are better equipped to understand their options, negotiate sensibly and reach an amicable settlement. Many cases can be resolved through constructive discussions, mediation or negotiation without ever becoming lengthy court battles.

The cost of getting things right at the beginning is often significantly less than the cost of fixing mistakes later.

As family lawyers regularly see, the cases that become expensive are not necessarily those where legal advice was sought early. More often, they are the cases where people relied on incomplete information, online templates or assumptions about what they were entitled to, only to discover months or years later that important issues had been overlooked.

There is nothing wrong with making the divorce process more efficient. Few people would argue against reducing unnecessary delay or bureaucracy. But efficiency should not come at the expense of informed decision-making.

The message should not be that people need a “quickie divorce”. The message should be that people need the right advice, at the right time, so they can make informed decisions about their future.

A divorce may be completed online in a matter of months. Achieving a fair and secure financial outcome, however, requires understanding, careful consideration and expert guidance.
