Missed the deadline?

Although the main deadline to apply to the scheme has passed, it may still be possible to make a late application in certain circumstances. Individuals who already hold pre-settled status may also need to apply to convert their status to settled status once they meet the requirements.

Understanding your rights under the EU Settlement Scheme and ensuring your immigration status is secure is essential for continuing your life in the UK.

Pre-settled status deadline

Pre-settled status deadline

The deadline for most people to apply for pre-settled status was 30 June 2021, if you were joining a family member then your deadline will be based on the date of arrival in the UK after 31st December 2020, providing:

  • your family member was living in the UK by the 31 December 2020 and
  • you were their family member by this date and
  • this relationship still exists at the time of application.

There are some exceptions to applying for pre-settled status after 30 June 2022 to find out if you are still eligible, please contact Ridley and Hall.

Late applications to the EU Settlement Scheme

Late applications to the EU Settlement Scheme

Although the main application deadline passed in June 2021, the Home Office may still accept late applications where there are reasonable grounds for missing the deadline.

Examples may include:

  • Children whose parents did not apply on their behalf
  • Individuals who were unaware they needed to apply
  • Vulnerable individuals or those with complex personal circumstances

Each case is assessed individually, and it is important to provide clear explanations and supporting evidence when submitting a late application.

Family members under the EU Settlement Scheme

In some cases, family members of EU, EEA or Swiss citizens may also apply under the scheme.

This can include:

  • Spouses or civil partners
  • Unmarried partners
  • Children or dependent family members

The eligibility of family members depends on the timing of the relationship and the immigration status of the EU citizen.
