The new year can often mean desire for a new start for individuals in an unhappy marriage or relationship.

In the lead up to Christmas and during the holiday period troubling issues can be tolerated or put to one side, often for the sake of the children. The new year and the simplified divorce process that removes blame and fault presents an opportunity to make change. At a time when families are under more stress and financial pressure than ever, individuals will need support and guidance to achieve the best separation possible.

This week lawyers expect a surge in demand of their divorce services, with a notable peak around the first week in January, due to the worsening of marital problems over the Christmas period. There can be suppressed disputes about children and what the future arrangements should look like. Often there are huge concerns as to how to create a financially stable future for two households from one.

Statistics from the National Centre for Domestic Violence show that referrals in January 2022, compared to December 2021, rose by 10%. The well-publicised cost of living crisis, supressed salaries, combined with the stress and expectations of the Christmas period, have been intolerable for many. The impact of this has been made worse by increased alcohol consumption when there is an expectation for families to spend time together. The dynamics can be very difficult and by the time the new year starts it can become obvious to many that a relationship needs to end.

At Ridley & Hall we can give you skilled, experienced and sensitive representation. We can help guide and support you through the various stages of your separation. We will evaluate your entitlement to spousal maintenance, consider pension sharing entitlement and look at what should happen to your house, bank accounts and property. Parenting arrangements for the children can be considered as the primary focus and shaped to suit the two households.
